PointRover Terms of Service
Effective: [DATE]
1. Agreement
By creating an account or using PointRover ("the Service"), you agree to these Terms. If you use the Service on behalf of a firm, you represent that you may bind that firm.
2. The Service
PointRover assembles informational maps of businesses from publicly available data published by government agencies and other public sources, and serves them through a dashboard and related interfaces. The Service is informational only. It is not financial, legal, tax, or investment advice, and no output constitutes a recommendation to take or refrain from any business action.
3. Accounts and access
The Service is currently invite-only. You are responsible for your credentials and for activity under your account. Workspace administrators control membership in their workspace and are responsible for who they invite. We may decline, suspend, or revoke access during the pilot at our discretion.
4. Acceptable use
You may not: attempt to access data of another customer; probe, scan, or test the Service's isolation; resell raw Service output as a standalone data product; use the Service to violate law; or interfere with the Service's operation. Automated access by an AI system you control, through interfaces we provide for that purpose, is an intended use.
5. Public data and accuracy
Service content is derived from public sources. We attribute figures to their sources and label staleness and gaps, but we do not warrant that any public source is accurate, complete, or current. Where a figure and its cited source disagree, the source controls.
6. Your data
Account information you provide is handled per the Privacy Policy. The Service does not require your clients' internal business data. If a workspace ends a client engagement or an account is closed, client-derived records are deleted as described in the Privacy Policy; minimal audit metadata (who did what, when) is retained.
7. Intellectual property
We retain all rights in the Service. You retain rights in information you submit. Public data remains public; our assembly, structure, receipts, and presentation are ours.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PILOT SOFTWARE MAY CHANGE, BREAK, OR BE DISCONTINUED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINTROVER'S TOTAL LIABILITY ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF THE FEES YOU PAID IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100), AND POINTROVER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR LOST PROFITS.
10. Termination
You may stop using the Service at any time; administrators may offboard clients, which deletes that client's derived data. We may suspend or terminate access for violation of these Terms.
11. Changes
We may update these Terms; material changes will be communicated to account holders. Continued use after changes is acceptance.
12. Governing law
These Terms are governed by the laws of the State of [STATE], excluding conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in [COUNTY, STATE].
